These Terms of Service ("Terms") govern your access to and use of Nesktop, including our website, web app, mobile apps, browser extension, desktop browser, organizations, public profiles, and related features (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms.

If you do not agree, do not use the Service.

1. About Nesktop

Nesktop is an independent software service operated from Türkiye under the Nesktop brand. Nesktop is not yet a registered company entity; formal company establishment is pending. These Terms are entered into on that basis.

2. Eligibility

You must be at least 13 years old (or the minimum age required in your country) to use the Service. By using the Service, you represent that you meet this requirement. If you are between 13 and the age of majority in your country, a parent or guardian should review these Terms with you.

The Service is not directed to children under 13 (or the applicable minimum age in your jurisdiction). We do not knowingly collect personal information from children.

3. Your account

You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You agree to provide accurate information and keep it up to date.

If you create an account using an email address, we may require you to verify that address (for example, by clicking a verification link) to activate certain features.

You must promptly notify us at nesktopinfo@gmail.com if you suspect unauthorized access to your account.

4. Email communications and account recovery

We may send you service-related emails, such as verification emails, password reset links, security alerts, receipts, and important notices about your account. Marketing emails require your separate affirmative opt-in and are easy to unsubscribe from.

If you request a password reset, we will attempt to send reset instructions to the email address on file. For your security, password reset links are time-limited and can be used only as described in the Service.

5. Content you provide and our license to operate

You retain all ownership rights to the content you save, upload, or create using the Service (for example, bookmarks, folders, layouts, notes, and settings). You grant Nesktop a non-exclusive, worldwide, royalty-free license to host, store, cache, transmit, display, and process your content solely to provide, maintain, and improve the Service for you and other users of the Service.

You represent that you have the necessary rights to submit your content and that your content does not violate applicable laws or third-party rights.

6. Public sharing, profiles, and community content

If you choose to make content publicly available (for example, through a public profile, shared layout, or public organization page), that content may be viewed by anyone without authentication and may be indexed by search engines. You are solely responsible for what you share publicly.

The NAPP Store lets signed-in users submit ratings, comments, and abuse reports. Ratings must reflect a genuine opinion and comments must remain factual, relevant, and respectful. We may review, hide, reject, or remove community content; retain a moderation audit record; and restrict abusive accounts. You may appeal moderation decisions by contacting nesktopinfo@gmail.com. Publishing a third-party web-app listing does not mean that the provider sponsors or endorses Nesktop.

7. Teams, organizations, and roles

Organizations let teams share layouts and settings. Organization owners have full control over membership, roles, billing, and public settings. Administrators and managers may publish, assign, and update layouts as granted by the owner. Members must follow their organization's policies when using managed layouts.

If you join an organization, your organization may set policies that affect your use of the Service in that context. Public organization pages are visible without authentication and must contain only material the organization is authorized to publish.

8. Browser extension and connected devices

If you choose to install and use the browser extension ("Extension"), you control what it can access through its settings and optional browser permissions. The Extension may access certain browser data (for example, bookmarks or popular sites) only when you enable the relevant feature, grant the optional permission when prompted, and explicitly request it (for example, by clicking "Pull browser").

The Extension does not automatically upload or store your full browser bookmarks tree on Nesktop servers. Only the specific items you explicitly choose to save or import into your Nesktop account are sent to our servers and stored as part of your account content.

Your browser may prompt you to grant permissions to the Extension; those permissions are governed by the browser's extension platform rules and your browser settings.

You are responsible for your device and browser security. If you connect a device or extension instance to your account, activity from that device may affect your account.

The desktop browser can keep multiple encrypted NESKTOP account profiles on one device. Selecting a profile changes the NESKTOP account, isolated browser session, organization context, and locally cached workspace used by that browser profile. You are responsible for removing stored profiles before sharing or transferring a device.

9. Mobile apps

The mobile apps provide a full browsing experience connected to your Nesktop account. The apps connect to the Nesktop service for login, sync, and personalized layouts. Your account, content, and settings are managed by the Nesktop service, and the apps are subject to these Terms and the relevant app store terms. Parental Control Mode is a safety feature for guardians to limit browsing; the apps are not directed to children.

10. Referral program

If you participate in the referral program, you agree to share your referral code responsibly and not spam, misrepresent, or abuse the program. Referral rewards are subject to eligibility criteria described on the referral page. We may modify or discontinue the program at any time.

11. Third-party sites and content

The Service may display links to third-party websites, services, or content. We do not control and are not responsible for third-party content, policies, or practices.

12. Subscription plans and billing

Some features may require a paid plan. Prices, features, and billing terms will be shown before you purchase. Taxes may apply.

Checkout is not yet live. Subscription purchasing is not currently available. When checkout becomes available, Lemon Squeezy is our intended Merchant of Record. These Terms will apply to subscriptions once launched.

For subscriptions (once available): paid subscriptions renew automatically at the end of each billing period unless you cancel before the renewal date. You are responsible for keeping your payment details current. Cancellation takes effect at the end of the current billing period; you retain access until then. Refunds, cancellation, withdrawal rights, and lifetime plan terms are governed by our separate Subscription, Cancellation, and Refund Terms.

Where applicable by mandatory consumer law, you may have a 14-day right of withdrawal from the date of purchase. However, if you expressly consent to us beginning the digital service before the withdrawal period ends and acknowledge that you lose the withdrawal right, you may not be entitled to a refund once performance has begun. Your statutory withdrawal and cancellation rights under applicable law are preserved and are not affected by these Terms.

For lifetime plans (once available): a one-time payment grants access for the commercial lifetime of the applicable Nesktop product or service, not the purchaser's personal lifetime. Access requires an active account in good standing. Voluntary account deletion ends access to the Service. If the applicable product or service is discontinued, your rights (including any refund rights) are governed by applicable law and the terms disclosed at purchase. Mandatory consumer rights under applicable law are not affected.

13. Beta features and availability

We may offer beta, preview, or early-access features. These features are provided "as is", may have reduced reliability or security, and may be changed or discontinued at any time without notice.

The Service may be changed, suspended, or discontinued at any time. Features that rely on network connectivity (including access to your account data across devices) and backups are best-effort and may fail or be delayed. You are responsible for maintaining your own copies of important information.

14. Acceptable use

You may not misuse the Service. For example, you may not:

  • attempt to access, probe, or disrupt the Service or its systems (including by scraping, scanning, or circumventing security features);
  • reverse engineer, decompile, or attempt to extract source code from the Service (except where permitted by law);
  • upload, transmit, or store unlawful, infringing, or harmful content;
  • use the Service to send spam, malware, or to perform abusive, fraudulent, or illegal activities;
  • impersonate another person or misrepresent your affiliation;
  • interfere with other users' use of the Service.

We may remove content or restrict accounts that violate these Terms.

15. Enforcement, suspension, and termination

We may suspend or terminate your access to the Service if you violate these Terms, if required to protect the Service or other users, or if required by law. We will attempt to notify you where practicable.

You may stop using the Service at any time and delete your account. Upon termination, your right to access the Service ceases. Sections of these Terms that by their nature survive termination (including content license, disclaimers, limitation of liability, indemnification, and governing law) remain in effect.

16. Account deletion and data export

You can request or initiate account deletion and export your data through the Service settings (where available). Deletion may not immediately remove copies in backups, but backups are retained only for limited periods. If you delete your account, you may lose access to content, subscriptions, and features associated with that account.

17. Feedback

If you provide feedback, ideas, or suggestions about the Service, you grant us the right to use them without restriction or compensation.

18. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, to the fullest extent permitted by law. This does not affect any mandatory consumer rights you may have.

19. Limitation of liability

To the fullest extent permitted by applicable law:

  • Nesktop will not be liable for indirect, incidental, special, consequential, or punitive damages; and
  • Nesktop's total liability for any claim arising out of or relating to the Service will not exceed the greater of (a) the amounts you paid to Nesktop for the Service in the 12 months before the event giving rise to the claim, or (b) $100.

Some jurisdictions (including Türkiye, EU/EEA member states, and the UK) do not allow certain limitations of liability for death, personal injury, fraud, or gross negligence. Nothing in these Terms excludes or limits liability where it would be unlawful to do so.

20. Indemnification

You agree to indemnify and hold Nesktop harmless from claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service or your violation of these Terms, to the extent permitted by law.

21. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of Türkiye, without regard to its conflict-of-law principles. Courts located in Istanbul, Türkiye will have exclusive jurisdiction for any dispute arising out of these Terms.

If you are a consumer in the EU/EEA, the UK, or Türkiye: nothing in this section deprives you of the protection of mandatory consumer protection laws of your country of residence. You may also bring proceedings in the courts of your country of residence.

22. Changes to these Terms

We may update these Terms from time to time. We will post the updated version and update the "Last updated" date. If changes are material, we will provide notice through the Service or by email. Continued use after the updated Terms take effect constitutes acceptance.

NESKTOP BROWSER EXTENSION — Terms of Use (EULA)

This section is extension-specific and describes how the Nesktop Browser Extension works, what permissions it may request, and what you control.

1. Acceptance

By installing or using the Nesktop Browser Extension ("Extension"), you agree to these Terms. If you do not agree, do not install or use the Extension.

2. Who may use the Extension

You must be legally able to form a binding contract in your country and comply with applicable laws.

3. What the Extension does (single purpose)

The Extension is designed to help you use Nesktop, including:

  • Replacing the browser New Tab page with a Nesktop dashboard (if enabled)
  • Letting you save the current page to Nesktop (if enabled)
  • Letting you preview and save eligible open-tab titles and URLs after you grant optional tab access and confirm a destination (if enabled)
  • Letting you add the current HTTP or HTTPS page directly to a selected Nesktop canvas page (if enabled)
  • Optionally showing your browser bookmarks and popular sites (from Chrome topSites) inside the Nesktop UI so you can organize and choose what to save

4. Your controls (Extension settings)

The Extension includes toggle switches to control features. You can:

  • Turn the Extension off entirely (master switch)
  • Enable/disable New Tab
  • Enable/disable "Save current page"
  • Enable/disable sharing browser bookmarks
  • Enable/disable sharing popular sites (topSites)

If a feature is OFF in the Extension, it is OFF even if the website requests it.

5. Accounts and sign-in state

Some features require a Nesktop account. For convenience, the Extension may keep its signed-in state consistent with the Nesktop web app so that signing in on one side reflects on the other.

The Extension does not collect or process your password.

6. License

We grant you a personal, non-exclusive, non-transferable license to use the Extension for its intended purpose. You may not copy, resell, reverse engineer, or abuse the Extension except as permitted by law.

7. Prohibited use

You agree not to:

  • Use the Extension to violate laws or third-party rights
  • Misuse it to exfiltrate data or access content without permission
  • Circumvent feature toggles, paywalls, or security controls
  • Interfere with the Extension, the website, or other users

8. Third-party websites

When you save a page or view content, you may interact with third-party websites. We are not responsible for third-party websites or their content.

9. Availability and changes

We may update, change, or discontinue the Extension (or parts of it). Some updates may be required for compatibility or security.

10. Disclaimers

The Extension is provided "as is" and "as available". We do not guarantee uninterrupted operation or error-free performance.

11. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or loss of data, profits, or business.

12. Termination

You may stop using the Extension anytime by uninstalling it. We may suspend or disable access if required by law, security, or policy compliance.

13. Governing law

These Terms are governed by the laws of the Republic of Türkiye. Courts located in Istanbul, Türkiye will have exclusive jurisdiction, unless mandatory law says otherwise.
