These Terms of Service ("Terms") govern your access to and use of Nesktop, including our website, apps, and browser extension (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms.
1. Who we are
Nesktop is a productivity service that helps you organize and sync bookmarks, folders, layouts, and related settings across devices.
2. Eligibility
You must be at least 13 years old (or the minimum age required in your country) to use the Service.
3. Your account
You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You agree to provide accurate information and keep it up to date.
If you create an account using an email address, we may require you to verify that address (for example, by clicking a verification link) to activate certain features.
You must promptly notify us if you suspect unauthorized access to your account.
4. Email communications and account recovery
We may send you service-related emails, such as verification emails, password reset links, security alerts, receipts, and important notices about your account.
If you request a password reset, we will attempt to send reset instructions to the email address on file. For your security, password reset links are time-limited and can be used only as described in the Service.
5. Subscription plans and billing
Some features may require a paid plan. Prices, features, and billing terms will be shown before you purchase. Taxes may apply.
Unless otherwise stated at checkout, paid subscriptions renew automatically until you cancel. You are responsible for keeping your payment details current.
6. Your content and permissions
You retain rights to your content (e.g., bookmarks and layouts). You grant us permission to host, store, and process your content to provide the Service.
You represent that you have the necessary rights to submit your content to the Service and that your content does not violate applicable laws or third‑party rights.
7. Browser extension and connected devices
If you choose to install and use the browser extension, you authorize the Service to access and sync the data required for the features you enable (for example, bookmarks, folders, layouts, and related settings). Your browser may also prompt you to grant permissions to the extension; those permissions are governed by the browser’s extension platform rules and your browser settings.
You are responsible for your device and browser security. If you connect a device or extension instance to your account, activity from that device may affect your account.
8. Acceptable use
You may not misuse the Service. For example, you may not:
- attempt to access, probe, or disrupt the Service or its systems (including by scraping, scanning, or circumventing security features);
- reverse engineer, decompile, or attempt to extract source code from the Service (except where permitted by law);
- upload, transmit, or store unlawful, infringing, or harmful content;
- use the Service to send spam, malware, or to perform abusive, fraudulent, or illegal activities;
- interfere with other users’ use of the Service.
We may remove content or restrict accounts that violate these Terms.
9. Third‑party sites and content
The Service may display links to third‑party websites. We do not control and are not responsible for third‑party content, policies, or practices.
10. Security, availability, and backups
We work to protect the Service and your data, but no system is 100% secure. You understand that:
- the Service may be changed, suspended, or discontinued at any time;
- synchronization and backups are best-effort and may fail or be delayed;
- you are responsible for maintaining your own copies of important information.
11. Account deletion and data export
You can request or initiate account deletion and export your data through the Service settings (where available). Deletion may not immediately remove copies in backups, but backups are retained only for limited periods.
If you delete your account, you may lose access to content, subscriptions, and features associated with that account.
12. Feedback
If you provide feedback, ideas, or suggestions about the Service, you grant us the right to use them without restriction or compensation.
13. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind to the fullest extent permitted by law.
14. Limitation of liability
To the fullest extent permitted by law:
- Nesktop will not be liable for indirect, incidental, special, consequential, or punitive damages; and
- Nesktop’s total liability for any claim arising out of or relating to the Service will not exceed the greater of (a) the amounts you paid to Nesktop for the Service in the 12 months before the event giving rise to the claim, or (b) $100.
Some jurisdictions do not allow certain limitations; in that case, these limitations apply to the fullest extent permitted.
15. Indemnification
You agree to indemnify and hold Nesktop harmless from claims, damages, liabilities, and expenses arising out of your use of the Service or your violation of these Terms.
16. Termination
We may suspend or terminate your access if you violate these Terms or if required to protect the Service.
17. Changes to these Terms
We may update these Terms from time to time. We will post the updated version and update the "Last updated" date.
